Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of the MainPlank platform and services (“Service”) provided by MainPlank (“we,” “our,” or “us”). By accessing or using the Service, you agree to be bound by these Terms.
1. The Service
MainPlank is a roster, casting, and communications management platform for theatre companies and performing arts organizations. It allows organizations to manage personnel records, coordinate productions, and communicate with cast members and crew via email and SMS.
2. Accounts and access
To use MainPlank as an organization administrator, you must create an account with a valid email address. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
You may not share login credentials or allow unauthorized users to access your organization's account. Notify us immediately at hello@mainplank.com if you suspect unauthorized access.
3. Organization responsibilities
Organizations using MainPlank to manage roster members and send communications are solely responsible for:
- Obtaining valid consent from individuals before adding their personal information to the platform or sending them communications
- Ensuring all SMS and email communications comply with applicable laws, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and any other applicable regulations
- The accuracy of roster data entered into the platform
- Honoring opt-out requests promptly and not re-adding individuals who have unsubscribed without their renewed consent
- Using the platform only for legitimate communications with people who have a genuine relationship with your organization
MainPlank provides the infrastructure for communications but is not responsible for the content or legal compliance of messages sent by organizations through the platform.
4. Acceptable use
You agree not to use the Service to:
- Send unsolicited bulk messages (spam)
- Harass, threaten, or harm individuals
- Violate any applicable law or regulation
- Attempt to gain unauthorized access to the platform or other organizations' data
- Reverse engineer, copy, or resell any part of the Service
- Upload malicious code or interfere with platform operations
We reserve the right to suspend or terminate accounts that violate these terms, with or without prior notice, at our sole discretion.
5. Data and privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described there.
You retain ownership of the data you enter into MainPlank. By entering data, you grant us a limited license to store, process, and transmit that data solely to provide the Service.
6. SMS messaging terms
Program name: MainPlank Notifications.
Program description: MainPlank sends SMS messages on behalf of participating theatre and arts organizations regarding auditions, casting decisions, rehearsal schedules, production updates, volunteer opportunities, ticketing notifications, and account-related alerts. You opt in by creating a MainPlank account, submitting a form provided by a participating organization, or otherwise providing your mobile number and agreeing to receive messages. Messages always identify the sending organization by name and are sent from 1-888-206-2578.
Message frequency: Message frequency varies based on your participation and the activity of the organizations you are connected with.
Message and data rates: Message and data rates may apply, depending on your mobile carrier and plan.
To opt out: Reply STOP to any message at any time. After you send STOP, we will send a one-time confirmation and then stop sending you SMS messages. Standard opt-out keywords are also supported: STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT. To opt back in, reply START.

Carriers are not liable for delayed or undelivered messages.
Organizations that send SMS messages through MainPlank agree to comply with all applicable carrier requirements, including Twilio's messaging policies and US carrier A2P (Application-to-Person) messaging regulations. Organizations must not use MainPlank's SMS features to send messages to individuals who have not consented or who have previously opted out. Misuse of SMS features may result in immediate account suspension.
7. Service availability
We aim to provide reliable, uninterrupted access to the Service but do not guarantee uptime. We may perform maintenance, updates, or modifications to the Service at any time. We are not liable for any losses arising from downtime or service interruptions.
8. Limitation of liability
To the maximum extent permitted by law, MainPlank shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.
Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the twelve months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless MainPlank and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.
10. Termination
You may stop using the Service at any time. We may terminate or suspend your access for violation of these Terms or for any other reason at our discretion. Upon termination, your right to access the Service ceases immediately. Data export requests should be made before account closure.
11. Changes to these Terms
We may update these Terms from time to time. We will notify organization account holders of material changes via email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles. Any disputes shall be resolved in the state and federal courts located in the State of Washington.
